Terms and Conditions – Hung Up Fashion

By renting a rack or purchasing an item from Hung Up located at Shop 2, 30-32 McAdam Square, Croydon VIC (“Hung Up”) you agree to, and are bound by, the below terms and conditions.

Shopping at Hung Up

  1. All sales are final. No refunds or exchanges will be offered on any purchases.
  2. Hung Up cannot guarantee the authenticity of any item’s brand or confirm that an item has not been altered or resized in any way.
  3. The price on a barcode is final (as discounted by the Seller from time to time), we are not the owner of the items and therefore are unable to negotiate pricing.

 

Selling at Hung Up

  1. Rack rental fees are non-refundable. If you book a rack and want to reschedule the booking date please email Hung Up and we will attempt to find alternative rental period. Bookings are unable to be rescheduled within 72 hours of the start date.
  2. Sales will be subject to 15% commission. 
  3. All items must be collected at least 15 minutes before the end of trading on the final day of your rack rental.
  4. By renting a rack you acknowledge and agree that we may photograph or film items displayed in store for promotional material and that your items may appear in social media posts, stories, advertisements or other marketing material.
  5. Hung Up actively promotes the store and selected items on our social media platforms. While we aim to showcase a variety of racks and pieces, inclusion in social media is not guaranteed. We do not have any obligation to feature specific racks, items or sellers. Selection of items shared is at our sole discretion. 
  6. We may charge a fee of $20 per day for the storage of any items which are not collected by the end of your rental period for a maximum of 10 days. After 10 days, we reserve the right to donate the items to a charitable cause of our choice.
  7. You warrant that you are the owner of the items being sold and that you have all legal and other rights necessary to place the item for sale on your rented rack.
  8. Hung Up will not be responsible for any items damaged, lost or stolen whilst in the store. We will take all reasonable steps to avoid any damage, loss or theft of any items during the rental period but all risk in the items remains with the Seller throughout the rental period.
  9. Hung Up’s total liability to you in connection with your rental (whether in contract, tort or otherwise) is limited to the cost of the rack rental.
  10. You will be provided with hangers for use during your booking. At all times these remain the property of Hung Up and must be returned to us at the end of your booking.
  11. Where you choose to apply a discount to your items, this will apply to the entire rack.
  12. All items must be clean and in good and saleable condition. We reserve the right to remove any items which are not in saleable condition from your rack.
  13. Any items which do not have a valid barcode will be removed from your rack.
  14. You give Hung Up permission to advertise your items on Instagram and other social media channels. However, we are under no obligation to advertise any of your items.
  15. Payment of your total sales amount (less commission) will be paid to your nominated bank account within 7 days of your rack rental ending. Please ensure that you provide us with your bank details when you pick up your items at the end of your rental period.
